Under the QFCRA Digital Asset Regulations, tokens that fall within the following categories are excluded from the purview of a permitted token (Excluded Token):

(a) a token that does not represent a right in any property (other than the token itself);
(b) a token is that is a substitute for, or represents, currency, or can otherwise be used as a means of payment; or
(c) a token that is designated as an Excluded Token by way of a notice or rule.

In other words, cryptocurrencies are prohibited since they function as a means of payment or currency, which places them within the category of Excluded Tokens under the QFCRA Digital Asset Regulations.

By imposing a broad exclusion, the QFCRA aims to:

  • maintain regulatory prudence by reducing the risk of money laundering, terrorist financing and speculative abuse.
  • maintain clarity by introducing a defined regulatory perimeter.
  • prioritise monetary stability and compliance with FATF and other international benchmarks.

However, a blanket crypto prohibition does not have to be the only way to maintain market integrity. Regulatory authorities in the UAE (including VARA and the ADGM’s FSRA) treat cryptocurrencies as permissible virtual assets provided they are not used as legal tender as well as meeting certain AML, governance and capital adequacy requirements. This has fostered a thriving Web3 and blockchain ecosystem in the UAE – something Qatar could have easily leveraged through its regulations instead of being restricted by it.

In my view, while it is apt to minimise systemic risks emanating from cryptocurrencies, a balanced approach is key.

A possible way forward could involve introducing a sandbox that permits the use of cryptocurrencies, stablecoins and tokenised deposits within a controlled environment. This could pave the way for a gradual and calculated expansion of Qatar’s digital asset ecosystem, fostering innovation while maintaining regulatory integrity.
